TERMS AND CONDITIONS

The terms and conditions form part of a binding contract between you and S.J.M or referred to as ‘we’ when you purchase a package and set out important information about our responsibilities to you and your responsibility to us.

Please be aware that once you have purchased your package you have no automatic right to cancel if you change your mind.

Before you purchase please make sure you have read these Terms and Conditions.

Terms and Conditions will change, so each time you purchase please read the terms and conditions that apply to that purchase.

Not all of the terms and conditions that apply to your purchase of the package are set out here. Therefore in addition please ensure that you have checked all of the following before you decide to purchase:


1 Conditions that apply to the Event

Admission to an event is at all times subject to the ticket conditions of the Promoter and to any other terms, conditions or rules that are applied by the venue operator. If you breach those terms, conditions or rules then the Promoter or venue operator may refuse admission or require you or other ticket holders to leave the venue.

Examples of ticket and/or venue conditions that may apply are: health and safety rules, security requirements (including security searches for the safety of those attending the event) and circumstances where ticket refunds are available. The venue and/or the Promoter will have rights to refuse admission or to eject you in certain circumstances and these are likely to include if you are involved with abusive, threatening, drunken or other anti-social behavior, or carry offensive weapons or illegal or prohibited substances or make unauthorized audio, video or photographic recordings. There will often also be rules restricting or preventing the admission of latecomers. Ticket and venue conditions will vary between events and between venues.

2. Additional restrictions or rules that apply to specific packages:

In addition to the terms and conditions please be aware there may be certain restrictions and rules relating to each package. You can find these listed on our website.



TICKETS

If your tickets haven’t been received 48 hours prior to the show or you have any ticket queries then please contact your ticket agent or your point of purchase.

Please ensure that you bring your tickets for the hospitality package with you to the event. These will need to be produced for authentication before you and your party are allowed to access hospitality areas.



PACKAGE CONTENT

Every reasonable effort will be made to provide the Packages as advertised or confirmed. We do however reserve the right to substitute any element for a suitable equivalent. We also have the right to change the Price at any time before purchase.

Where merchandise or vouchers are included in your package we will usually deliver it to you before the event or make it available for collection at the venue. Where we are not able to do this we shall post such merchandise and/or vouchers to the delivery address provided by you at the time of booking with the ticket agents, within a reasonable time after the event.

Where multiple artiste members or multiple artistes are scheduled to appear, we reserve the right to amend published line-ups due to reasons outside of our reasonable control.

All package timings given out in advance are provisional and may be subject to change. We reserve the right to amend timings without notice on the day. Where the start time to a package is amended in advance of the show day, we will make every reasonable effort to inform customers of this change.



RESELLING OF HOSPITALITY PACKAGE

You are not permitted to re-sell or transfer the package to anyone else unless we have first agreed to this in writing.



CUSTOMER SATISFACTION POLICY

If before or during an Event which forms part of the VIP Package you have any complaint, you should tell us straightaway so that we have the opportunity to put things right. If you make a complaint we will investigate it and try to rectify the situation. You can contact us with any concern or complaint as follows:

  • Prior to or after the event: contact our customer service team at customerservices@SJMCONCERTS.com which is operational 9am-6pm Monday-Friday.
  • At the event: speak to our VIP manager at the venue or a steward.

Customer service is important to us, if you are not completely satisfied with your experience then please contact us.



OUR RESPONSIBILITY TO YOU

If an event is cancelled – we will refund you the cost of the package.

If an event date is postponed or an event is rescheduled - we will notify you of the change and offer you the chance to transfer your package to the new date. You can refuse this option and receive a refund provided that you contact us within 14 days of us sending the notification to you.

If we are unable to deliver part of your package or are delayed in doing so due to circumstances beyond our reasonable control, our responsibility will be to make every reasonable effort to minimise delays and (where applicable) to replace any part of the package with a reasonable alternative. Provided we do this you will not be entitled to a refund.

We will not in any circumstances be liable for:

  • Any loss of the benefits of your package because of a breach by you or your guests of these terms and conditions and/or the terms and conditions imposed by the venue or the promoter for the event
  • Any business losses you may incur
  • Any ancillary costs you may have incurred- for example travel costs or accommodation unless these were part of the package you purchased
  • Any payments for disappointment, lack of enjoyment or similar.


YOUR RESPONSIBILITY TO US

You are responsible for your behaviour and for that of all of those benefitting from the package as your guests and for their compliance with these conditions, the ticket and venue conditions that apply to the event and with any additional conditions that apply to your package.

You must ensure that those using our facilities behave in a responsible and courteous manner at all times whilst at the event and participating in the package.

You agree to be responsible for the safekeeping of any property brought by you or your guests to the event and agree and accept that we shall not be responsible for any damage or loss to your property or that of your guests.

You agree to promptly pay for the full cost of any damage caused by you or your guests to the premises, facilities or equipment made available to you and your guests.

You agree to reimburse us in full for any losses we incur as a result of your failure (or failure by any of your guests) to comply with the conditions applicable to your package and/or to the event.



PRIVACY and DATA PROTECTION

SJM Concerts only collects personal information about you when you specifically provide us with, name, address, telephone number and email address on a voluntary basis. Any personal information we collect via our website will never be released or sold to any individuals or companies.

If you have registered your interest with www.sjm-vip.com you have thereby given your consent, you may be contacted with relevant promotions, offers or information that you have expressed an interest in or that might be of interest to you.

We will not share your personal information for marketing or any other purposes without your consent unless where required by law.

We will always respect your privacy and any personal communication between you and ourselves.

We will always comply with United Kingdom data protection legislation

FILMING, PHOTOGRAPHY, AUDIO AND/OR VISUAL

You hereby give your express consent for your actual self to be shown on film, photograph, audio and/or audio-visual recording on the SJM-VIP website or at an event to be exploited in any and all media for any purpose at any time for no fee.

This includes filming by the police or security staff which may be carried out for the security of customers or the prevention of crime.



EXTERNAL WEBSITES

SJM Concerts do not control the external websites which are linked to SJM-VIP Website and we can therefore not be held responsible for their content.



CONTRACTS (RIGHTS OF THIRD PARTIES) ACT 1999

This contract is between you and us. No other person shall have any rights to enforce any of its terms.



GOVERNING LAW AND JURISDICTION

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. You agree, as we do, to submit to the exclusive jurisdiction of the English Courts, save in relation to enforcement of any judgment, in which case such jurisdiction shall be non-exclusive.



WAIVER

If you breach these Terms and Conditions and we take no immediate action, we will still be entitled to assert our rights in relation to any such breach and to in relation to any further breach of these Terms and Conditions.
